Rivervue Retirement Village Class Action
Litigation Lending is funding a class action for damages filed by Mayweathers together with William Roberts Lawyers against Melbourne Water Corporation, on behalf of residents at the Rivervue Retirement Village in Melbourne who suffered loss and damage following the flooding of the Maribyrnong River in October 2022. The class action alleges negligence against Melbourne Water, founded on its conduct in producing and using faulty and/or inadequate flood modelling, and its processes for approving lower finished floor levels for the development of the Rivervue Retirement Village.
The class action further alleges that residents at the Rivervue Retirement Village suffered loss and damage, including economic loss, injurious affection to the value of their leasehold interests, and disappointment and distress because of Melbourne Water’s alleged negligence.
The group members are those persons who currently hold, or previously held, a leasehold interest in a residential property at the Rivervue Retirement Village on or after the flood event on 14 October 2022 and have suffered loss and damage because of Melbourne Water’s alleged negligence.
